‘Serious Fraud’: Judge Allows Trump Admin To Withhold MN’s Medicaid Funds!

Judge Eric Tostrud recently denied Minnesota’s request to block the Trump Administration from withholding over $243 million in Medicaid funds. This legal battle began when Minnesota Attorney General Keith Ellison sued the Centers for Medicare and Medicaid Services (CMS), arguing that the funding freeze was a political maneuver disguised as fraud prevention. However, Judge Tostrud ruled that the state filed its lawsuit prematurely, as the CMS administrative review process is still ongoing. The court emphasized that federal intervention is typically reserved for final agency decisions, noting that Minnesota has previously acknowledged its own “serious fraud problem” regarding state-run social services.

The Trump Administration, represented by CMS Administrator Mehmet Oz and “fraud czar” Vice President JD Vance, maintains that the deferral is necessary to ensure documentation supports all reimbursement claims. While Minnesota argued that the scale of the funding pause is historically unprecedented and could cripple the state budget, Judge Tostrud found the action likely complies with current federal regulations. Although the judge admitted the state raised valid legal concerns regarding the motivations behind the freeze, he concluded there is currently no evidence of bad faith. The state must now navigate the CMS verification process to potentially recover the withheld funds through a corrective action plan.
