The incident allegedly occurred during a congressional visit to the Delaney Hall immigrant detention center, where video evidence reportedly depicts McIver physically impeding federal agents. Faced with a three-count indictment, the congresswoman could potentially serve 17 years in federal prison. Her defense team, led by attorney Lee Cortes, has invoked the Speech or Debate Clause, arguing her actions are protected under congressional privilege. This legal maneuvering has sparked intense criticism from supporters of the Department of Homeland Security (DHS), who view the assault as a blatant violation of national sovereignty.

Adding to the controversy, U.S. District Judge Jamel Semper issued a blockbuster ruling ordering the DHS and the Department of Justice (DOJ) to scrub social media posts critical of McIver. The judge expressed concerns that online statements could prejudice a future jury pool. U.S. Deputy Attorney General Todd Blanche confirmed the removal of several posts on X to comply with this gag order. Despite the court’s intervention, the Republican majority in the 119th Congress remains steadfast in its pursuit of law and order.
